The Etzensperger Informatik AG (hereinafter “Service Provider”) is available at *.edoobox.com, *.edoobox.ch and other top-level domains for products, software and services (hereinafter referred to as “edoobox” or “services “). By using these services you agree to these Terms and Conditions (hereinafter “GTC”). The service provider reserves the right to change the terms and conditions at any time without notice. You can find the latest version of the GTC at https://edoobox.com/agb.pdf. If any provision of these Conditions is or become invalid, the validity of the remaining provisions remains unaffected. The service provider reserves all copyrights and other rights to edoobox. You must not remove, cover, or alter legal notices (such as copyright or trademark). You must not use the trademarks of edoobox (esp. EDOOBOX) for your own purposes, no matter what kind. By the violation of the provisions, you will forfeit your right to use the services, and the service provider will be entitled to close your account or block the access to the services. These Terms constitute the entire agreement between you and the service provider, and replace all prior agreements under this title. Verbal agreements are of no value. The terms apply in every case in accord with Swiss law, regardless of your location. The competent jurisdiction court is at the seat of the service provider.
The service provider does not guarantee that (i) the services correspond to your requirements or expectations, (ii) the services be continuous, reliable and error free, (iii) the results you receive by the use of the services be correct and reliable, (iv) possible errors in the services be corrected. The service provider is not responsible for direct or indirect damage of any kind that results through: (i) the use and/or the inability to use the services, (ii) changes in the services, (iii) permanent and temporary non-availability of services, (iv) non-availability of correct data processed by the service, (v) or any other cause in connection with the services. The service provider offers technical support on a “best efforts” basis and exclusively via e-mail. The service provider does not guarantee the availability of technical support. The service provider has the right to make use of service provision at any time with any of the services of third parties. The service provider has the right to discontinue the services (or any part thereof) at any time permanently or temporarily, remove, change or add new services. The changes are subject automatically to these regulations. By the further use of the services after such changes, you must be in agreement with the changes tacitly.
You agree to use the Services only in accordance with (i) the terms contained herein and (ii) with the regulations and legislation relevant to you. For some services (or portions thereof), the service provider may require you to register for an account. You must provide all necessary information during registration completed correctly and truthfully and you must keep it up to date. You are also responsible for the security of your password. It is not permissible to create accounts automatically. You agree not to intentionally disrupt the services in any manner. You agree not to reproduce the Services for any purpose, or copy, sell, trade or redistribute. You must agree to the privacy policy of the service provider. It is available at https://www.edoobox.com/about/ppo.pdf. The service provider reserves the right (but is not obligated) to review content or services within the accounts, or filter, modify, reject or delete them. You acknowledge that you must not publish through edoobox data that are offensive, indecent or objectionable in any other manner.
There is no entitlement to registration, membership, use of the edoobox website or use of services from edoobox. In particular, the service provider is free to refuse registration, exclude a member, prohibit use or discontinue a service at any time.
Some services (or parts thereof) are financed by advertising and / or other promotional measures. The fading of these advertisements can be controlled by the information arising from the use of the Services. The nature and extent of advertising can change at any time. You agree that edoobox displays advertising. If you use a free service, you must not block the ads.
The use of the API (“application programming interface”) is subject to these terms and conditions and the following specific provisions: Excessive use or abuse of the API can result in a temporary or permanent blocking of access to the API. The service provider decides solely, when the use is unreasonable or excessive. The service provider reserves the right to change your access to the API at any time, or discontinue it temporarily or permanently. The service provider particularly reserves the right to limit the number of inquiries and transactions per time unit. The service provider is free to inform of any such change or adjustment. The service provider reserves the right to carry on the API in a paid service, and to offset some or all of the inquiries and transactions. In this case, it is free to you as a user of the API to end the use of the API or continue to use it against payment.
The use of downloadable plug-ins (eg Outlook plug-in) is subject to these terms and conditions and the following specific provisions: A plugin can automatically download updates and install them in edoobox. Such updates can be either bug fixes, feature enhancements, additional features, or entirely new versions. You agree to receive such updates. The service provider reserves the right to carry over some or all of the plugins in a paid service and to offset some or all of the use of plugins. In this case, you are free as a user of the plug-ins to end the use of the plug-ins or continue to use them against payment.
The service provider makes its website edoobox.com (and other top-level domains) available to its registered members as a booking system (platform) for booking and offering courses, seminars and other events (hereinafter: "offers"). For the sake of simplicity, these GTC refer to the offering organisation as the "Provider", the acquirer as the "Booking Person" and the acquisition as the "Booking" or "Booking".
On this accounting system, members can exchange autonomously and responsibly, contract, and advertise courses (course bookings). The obligations arising from such contracts apply to the school offering the book and to the end user of the course. The application of the contract is the exclusive responsibility of the schools and students.
The service provider is not a party of contracts concluded between the members on the reservation system. The service provider, its agents, employees and support staff are in no way responsible for the description and the booking of courses and the risks associated, and in any way are liable for any resulting damages. The service provider is not obligated to control the behavior of its members in connection with the use of the booking system. In particular, the service provider can, but is not obliged, check on the legality of the reservations and published courses, texts and illustrations of its members.
The Unlimited use of edoobox terms and conditions are subject to the following specific provisions that also apply to the table of subscriptions specifications. It is available at https://www.edoobox.com/about/abo.pdf. Unlimited edoobox is billed in advance. The refund is excluded. Reimbursement is explicitly excluded in the following cases: failure of service during the subscription period, downgrade, partial use of the services, or change in functionality. An ad free Unlimited edoobox is a (usually paid) site shown in edoobox without advertising. Unlimited edoobox must be equipped at all times with reasonable access control settings, and you must restrict the setting of the new entries to the authorized users (i.e. the users of your organization). The access control settings can be based on the email address domain, on the internal IP addresses, or on passwords in your organization. Unless after agreement in writing with the service provider, an ad free Unlimited edoobox must not be made publicly available under any circumstances. An ad free Unlimited edoobox must be used only by the leading organization in an account in a branch or office in one place. Excessive use or abuse of Unlimited edoobox may result in a temporary or permanent blocking of access. The service provider decides solely, when a use is unreasonable or excessive. The service provider reserves the right to block permanently or temporarily an Unlimited edoobox account, if these provisions are violated. If an account is locked, the service provider send via email a block alert to the account holders. Unlimited edoobox is always associated with a My-edoobox account. The service provider always communicated via the My-edoobox account registered email address. It is your responsibility to keep the email address up to date.
The use of Limited edoobox is subject the general terms and conditions as well as to the following specific regulations, besides the subscription specifications. It is available at https://www.edoobox.com/about/abo.pdf. Edoobox Limited is a (usually paid) site shown in edoobox with advertising. Limited edoobox is billed in advance. Any refund is excluded. Reimbursement is explicitly excluded in the following cases: failure of service during the subscription period, downgrade, partial use of the services, change in functionality. Limited edoobox must be equipped with meaningful access control at any time, which means limiting the new entries to the authorized users (i.e. the users of your organization). The access control settings can be based on the email address domain, on the internal IP addresses, or the passwords in your organization. Unless agreed in writing with the service provider, you must not make Limited edoobox publicly available under any circumstances. Excessive use or abuse of Limited edoobox may result in a temporary or permanent blocking of access to the services. The service provider decides solely, when a use is unreasonable or excessive. The service provider reserves the right to block permanently or temporarily the Limited edoobox account, if these provisions are violated. The sole service provider decides when there is a violation. If an account is locked, the service provider informs the account holder via email. Limited edoobox is always associated with a My-edoobox account. The service provider always communicate via the registered email address of the My-edoobox account. It is your responsibility to keep the email address up to date.
The use of Free edoobox is subject to the general terms and conditions as well as to the following specific regulations, besides the table subscription specifications. An organization must have maximally 1 Free edoobox account. Such a site must at all times be equipped with reasonable access control, restriction settings of new entries to the authorized user (access limited to the users of your organization). The access control settings can be based on the email address domain, on the internal IP addresses, or the passwords in your organization. Excessive use or abuse of Free edoobox may result in a temporary or permanent blocking of access to the services. The service provider decides solely, when a use is unreasonable or excessive. The service provider reserves the right to block permanently or temporarily the Free edoobox account, if these provisions are violated. If an account is locked, the service provider informs the account holder via email. Free edoobox is always associated with a My-edoobox account. The service provider always communicate via the registered email address of the My-edoobox account. It is your responsibility to keep the email address up to date.
Instead of cancelling the edoobox subscription, it is sufficient to downgrade to edoobox Business (low-cost account), this way the information about offers and participants will be preserved. If you want to delete your edoobox account, you will find the box "My edoobox subscription" in the V1 in the edoobox settings, in this box you will find the button to delete your edoobox account. In case of expired testing you will find the delete button at the bottom of the lock screen.
The service provider reserves the right to change the prices of all services at any time. Price changes will be communicated by mail at least one month before they come into effect. The service provider cannot be held liable to you or any third party for price changes or any consequences resulting from price changes.
