Etzensperger Informatik AG, Kirchweg 24, CH-3366 Bettenhausen (hereinafter referred to as "Service Provider") provides products, software and services (hereinafter collectively referred to as "edoobox" or "Services") under *.edoobox.com, *.edoobox.ch and other top-level domains. Users of the Service may be consumers or business customers. By using these Services, you agree to be bound by these Terms and Conditions (hereinafter referred to as "Terms and Conditions"). The Service Provider reserves the right to amend the GTC at any time without prior notice. Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The service provider retains all copyrights and other rights to edoobox. You may not remove, obscure or alter any legal notices (e.g. copyright or trademark notices). You may not use the trademarks of edoobox (esp. EDOOBOX) for your own purposes - of any kind. By violating the terms, you forfeit your right to use the services and entitle the service provider to block your account or access to the services. These TOS constitute the entire agreement between you and the Service Provider and supersede all prior agreements under this title. There are no verbal side agreements. Swiss law applies in all cases, regardless of your location. The place of jurisdiction is the competent court at the registered office of the service provider.
The Service Provider does not warrant that (i) the Services will meet your requirements or expectations, (ii) the Services will be uninterrupted, timely, secure and error-free, (iii) the results obtained from the use of the Services will be accurate and reliable, (iv) any errors in the Services will be corrected. The Service Provider shall not be liable for any direct or indirect damages of any kind resulting from: (i) the use or inability to use the Services; (ii) changes to the Services; (iii) permanent and temporary unavailability of the Services; (iv) unavailability or incorrect availability of data processed by the Services; (v) or other causes related to the Services. Service Provider shall provide technical support on a "best efforts" basis unless a separate SLA Agreement has been agreed. Service Provider does not warrant the availability of technical support. The Service Provider shall have the right to use the services of third parties for the provision of the Service at any time and to any extent. The Service Provider has the right to permanently or temporarily discontinue, remove or modify the Services (or any part thereof) or add new Services at any time. Such changes shall automatically be subject to these Terms. Your continued use of the Services following such changes constitutes your tacit acceptance of the changes.
You agree to use the Services only in accordance with (i) these Terms and (ii) the regulations and legislation relevant to you. For some Services (or parts thereof), the Service Provider may require you to register for an account. You are required to accurately and truthfully complete and keep current all information required as part of any registration. You are also responsible for the security of your password and all actions taken on your edoobox account. You may not create accounts automatically. You agree not to intentionally interfere with or disrupt the Services in any way. You agree not to reproduce, copy, sell, trade or redistribute the Services for any purpose. You agree to be bound by the Service Provider's Privacy Policy. The Service Provider reserves the right (but is not obligated) to review, filter, modify, reject or delete any content or accounts within the Services. You acknowledge that by using edoobox you may be exposed to data that is offensive, indecent or otherwise objectionable.
There is no entitlement to registration, membership, use of the edoobox website or use of services from edoobox. In particular, the service provider is free to refuse registration, exclude a member, prohibit use or discontinue a service at any time. If the edoobox account is suspended or deleted, the User shall not be entitled to any compensation, indemnity or refund.
The software and underlying technical solutions, including any related or integrated components, are the exclusive property of the Service Provider and/or its licensors.
Users are not permitted to access, use or disclose the source code. Any rights to the procedures, algorithms and technical solutions contained in the software and related documentation are the sole property of the Service Provider.
Some services (or parts thereof) are financed by advertising and / or other promotional measures. The fading of these advertisements can be controlled by the information arising from the use of the Services. The nature and extent of advertising can change at any time. You agree that edoobox displays advertising. If you use a free service, you must not block the ads.
The use of the API (“application programming interface”) is subject to these terms and conditions and the following specific provisions: Excessive use or abuse of the API can result in a temporary or permanent blocking of access to the API. The service provider decides solely, when the use is unreasonable or excessive. The service provider reserves the right to change your access to the API at any time, or discontinue it temporarily or permanently. The service provider particularly reserves the right to limit the number of inquiries and transactions per time unit. The service provider is free to inform of any such change or adjustment. The service provider reserves the right to carry on the API in a paid service, and to offset some or all of the inquiries and transactions. In this case, it is free to you as a user of the API to end the use of the API or continue to use it against payment.
The use of downloadable plugins or edooox apps (e.g. Outlook plugin, WordPress plugin, Google or Apple mobile apps, etc.) is subject to these TOS and the following specific terms: A plugin/app may automatically download and install updates from edoobox. Such updates may be bug fixes, feature enhancements, additional functionality or entirely new versions. You agree to receive such updates. The Service Provider reserves the right to convert some or all of the Plugins/Apps into a paid service and to charge for certain or all use of the Plugins/Apps. In this case, you as a user of the plugins/apps are free to stop using the plugins/apps or to continue using the plugins/apps for a fee.
The service provider makes its website edoobox.com (and other top-level domains) available to its registered members as a booking system (platform) for booking and offering courses, seminars and other events (hereinafter: "offers"). For the sake of simplicity, these GTC refer to the offering organisation as the "Provider", the acquirer as the "Booking Person" and the acquisition as the "Booking" or "Booking".
On this accounting system, members can exchange autonomously and responsibly, contract, and advertise courses (course bookings). The obligations arising from such contracts apply to the school offering the book and to the end user of the course. The application of the contract is the exclusive responsibility of the schools and students.
The service provider is not a party of contracts concluded between the members on the reservation system. The service provider, its agents, employees and support staff are in no way responsible for the description and the booking of courses and the risks associated, and in any way are liable for any resulting damages. The service provider is not obligated to control the behavior of its members in connection with the use of the booking system. In particular, the service provider can, but is not obliged, check on the legality of the reservations and published courses, texts and illustrations of its members.
The use of edoobox is subject to these GTC and the following specific terms and conditions. edoobox subscriptions are charged monthly to the provider's account. Any refund is excluded. Refund is explicitly excluded also in the following cases: Failure of the services during the subscription period, downgrade, partial use of the services, change in the scope of functions. An edoobox account must be equipped at all times with reasonable access control settings that restrict the creation of new entries to authorized users (i.e. the provider's employees). Access control settings may be based on the email address domain or passwords of the provider. Unless otherwise agreed in writing with the service provider, an edoobox subscription may not be made publicly available under any circumstances. A provider may have a maximum of 1 free subscription (e.g. free-edoobox). Excessive use and abuse of edoobox may result in the temporary or permanent blocking of access. The service provider alone decides when a use is abusive or excessive. The service provider reserves the right to block an edoobox account permanently or temporarily if these provisions are violated. When a violation occurs, the service provider decides alone. If an account is suspended, the service provider will notify the account holder of the suspension via email. edoobox subscriptions are always associated with an edoobox account. The service provider always communicates via the e-mail address stored in the relevant edoobox account. The service provider is responsible for keeping the e-mail address up to date.
Liability, damage and recourse claims are limited to the amount of the subscription costs of the preceding 12 months, except in cases of intentional action. Further liability claims are excluded.
A subscription upgrade or downgrade is possible at any time and effective immediately, unless there is a special agreement, such as an annual contract. A downgrade is only possible if your entries allow it (possibly a prior deactivation of functions that are only available in higher subscriptions is necessary). Resulting higher or lower subscription prices will take effect immediately. A trial period at account opening expires automatically and does not turn into a paid offer, unless the user explicitly chooses a paid option.
Instead of cancelling your edoobox subscription, it is sufficient to downgrade to edoobox Business (low-cost account), this way the information about offers and participants will be preserved. If you want to delete your edoobox account, you will find the box "My edoobox subscription" in the edoobox settings, in this box you will find the button to delete your edoobox account. In case of expired testing you will find the delete button at the bottom of the lock screen.
The use of Free edoobox is subject to the general terms and conditions as well as to the following specific regulations, besides the table subscription specifications. An organization must have maximally 1 Free edoobox account. Such a site must at all times be equipped with reasonable access control, restriction settings of new entries to the authorized user (access limited to the users of your organization). The access control settings can be based on the email address domain, on the internal IP addresses, or the passwords in your organization. Excessive use or abuse of Free edoobox may result in a temporary or permanent blocking of access to the services. The service provider decides solely, when a use is unreasonable or excessive. The service provider reserves the right to block permanently or temporarily the Free edoobox account, if these provisions are violated. If an account is locked, the service provider informs the account holder via email. Free edoobox is always associated with a My-edoobox account. The service provider always communicate via the registered email address of the My-edoobox account. It is your responsibility to keep the email address up to date.
The Service Provider reserves the right to change the prices of all services at any time. Price changes will be communicated by mail at least one month before they come into effect. The Service Provider shall not be liable to you or any third party for any price changes or any consequences resulting from price changes.
